Aussie Band Goes Down in Court

Men At Work, the Australian band fronted by Colin Hay that put out a song in 1982 you still can't get away from, has lost a court case that could cost millions. A Federal Court Judge in Australia has ruled that Down Under, the song on the album Business As Usual that helped propel the band to worldwide fame, took a 'substantial part' of its melody from the children's song Kookaburra Sits In The Old Gum Tree.  The flute part in the song is what apparently convinced the court.  We can only hope the decision reduces the amount of play the song gets in stores and restaurants.
